The deal while Gestura is free.

The short version: the beta is free, and in exchange the images you submit can be used to train our sign language models. The longer version is below, written in plain language by the person who built it.

The short version

  • Gestura is free during the beta. You do not pay, and we do not promise uptime, accuracy, or a particular feature set.
  • If you submit images, video frames, or sign samples to Gestura during the beta, you agree they can be used to train our AI models, and you do not expect payment or any other compensation now or later.
  • You keep ownership of what you submit. You grant us a worldwide, royalty-free license to use it for training and improving Gestura.
  • You agree to use Gestura lawfully, not to abuse the service, and not to submit content you do not have the right to share.
  • The on-device camera promise in the Privacy Policy still holds: real-time translation is processed on your phone and does not leave it.

Who you are agreeing with

These Terms & Conditions ("Terms") are a contract between you and the future Gestura d.o.o., an independent studio based in Croatia ("Gestura", "we", "us"). By creating an account, joining the waitlist, downloading the app, or using the website, you agree to these Terms. If you do not agree, do not use Gestura.

If you are using Gestura on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

Beta program and training data

Gestura is currently a free beta. That has two meaningful consequences you should read carefully.

1. It is provided "as is"

  • The product is incomplete and under active development. Features may change, break, disappear, or behave unexpectedly.
  • We do not promise any specific level of accuracy in translation, availability of the service, or compatibility with your device.
  • We do not promise that the beta will continue, that paid plans will exist, or that current users will receive any benefit if a paid version launches.

2. Submitted images and signs may be used to train our models

This is the part that funds the beta being free, so it is intentionally explicit.

By using Gestura during the free beta, you agree that:

  • Any images, video frames, sign samples, or other media you submit to Gestura (for example through contribute, feedback, or correction flows in the app or website) may be used by Gestura to train, evaluate, and improve our sign language AI models.
  • This use is royalty-free, perpetual, irrevocable, worldwide, and sublicensable to the people and infrastructure we work with to build the models (for example, annotation partners, research collaborators, and compute providers).
  • You do not expect and are not entitled to any payment, equity, credit, attribution, revenue share, or other compensation now or in the future as a result of your contribution, including if Gestura later becomes a paid product or is acquired.
  • You will not later claim that your contribution should have been paid for, or attempt to revoke this license for content already used in training. Once a model has been trained on a sample, we cannot meaningfully "untrain" it.
  • You confirm that you have the right to submit the content (for example, you are in the video, or every identifiable person in it has agreed) and that submitting it does not violate anyone else's rights.

You always retain ownership of what you submit. The license above is the right we need in order to learn from it.

The on-device translation flow described in the Privacy Policy does not send your live camera feed off your phone. The training license above only applies to content you actively submit to Gestura, not to anything processed locally and discarded by the app.

3. Withdrawing future contributions

You can stop contributing new training data at any time by:

  • turning off contribute or feedback features in the app, or
  • emailing info@getgestura.com and asking us to stop using new submissions from your account.

We will honor that going forward. We cannot retroactively remove your past contributions from models that have already been trained on them.

Your account

  • You are responsible for the email and credentials you use to sign in.
  • You agree to give us accurate information when we ask for it (for example, a valid email at sign-up).
  • You are responsible for activity that happens under your account. Tell us at info@getgestura.com if you think someone else has accessed it.
  • We may suspend or terminate accounts that violate these Terms, abuse the service, or put other users or our infrastructure at risk.

Acceptable use

When you use Gestura, you agree not to:

  • Use the service to harm, harass, defame, or impersonate anyone.
  • Upload content you do not have the right to share, including signs performed by people who have not agreed to be recorded.
  • Upload content that is unlawful, sexually explicit involving minors, or that promotes violence or discrimination against a protected group.
  • Attempt to reverse engineer the on-device models, scrape the service, or use it to build a competing product.
  • Interfere with the service, our infrastructure, or other users.

We can remove content and suspend accounts that break these rules.

Intellectual property

  • Our IP: the Gestura brand, app, website, models, and content we create are owned by Gestura. You receive a limited, non-exclusive, non-transferable license to use them for their intended purpose.
  • Your IP: content you submit stays yours. You grant Gestura the licenses described in the Beta section above for the purpose of running and improving the service.
  • Open source: parts of Gestura use third-party open source components, each under its own license. Those licenses continue to apply.

Disclaimers

Gestura is provided "as is" and "as available". To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of translations, and non-infringement.

Gestura is not a substitute for a qualified human sign language interpreter in high-stakes settings (medical, legal, emergency, employment). Do not rely on it where a wrong translation could cause harm.

Limitation of liability

To the maximum extent allowed by law, Gestura and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of your use of the service.

Our total liability for any claim related to Gestura, in aggregate, is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred euros (EUR 100). Since Gestura is currently free, (b) is the practical cap.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for fraud, willful misconduct, or death or personal injury caused by negligence).

Indemnity

You agree to indemnify and hold Gestura harmless from claims arising out of (a) content you submit, (b) your violation of these Terms, or (c) your violation of someone else's rights.

Suspension and termination

  • You can stop using Gestura at any time, and delete your account by emailing info@getgestura.com.
  • We can suspend or terminate access at any time, for any reason, including ending the beta or shutting the service down.
  • Sections that by their nature should survive termination (training license for already-submitted content, IP, disclaimers, liability limits, governing law) will survive.

Changes to these Terms

We will update these Terms when the product or the law changes. Material changes get a banner on the homepage and an email to waitlist members. The "last updated" date at the top of this page always reflects the most recent version. Continuing to use Gestura after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Croatia, without regard to conflict-of-law rules. If you are a consumer in the European Union, you keep any mandatory protections of the law of your country of residence. Disputes that cannot be resolved by writing to us first will be brought before the competent courts in Croatia, except where mandatory consumer law says otherwise.
